Justice Nnamdi O. Dimgba (pictured, left) of a Federal High Court in Abuja has thrown out a case brought before him by the Department of State Services (DSS) on Monday 8 August 2016. The judge's decision was taken after the DSS refused to heed his previous court ruling on another case where he ordered one Air Commodore Umar Mohammed (Rtd.) to be transferred to Kuje Prisons, Abuja pending a bail application filed by the suspect but the DSS refused, keeping the suspect in their own custody.

DSS through its lawyer GOA Agbadua brought an appeal for a remand warrant but Justice Dimbga, furious, struck out the case out before it could begin.

His words:
"The court will not grant any application of the DSS until there is sufficient proof that all orders of the court have been obeyed.

"It will be counter-productive for the court to take this application and grant the reliefs sought by the DSS.

"This court hereby adjourns this application sine die until the applicant’s counsel files an affidavit deposing to the fact that all outstanding orders of this court on the DSS have been complied with."
